1. Acceptance of Terms

By downloading, installing, or using the App, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement.

2. No Subscription Fees and Third-Party Purchases

2.1 No Subscription Required

• The App is currently provided without a paid subscription.
• We may offer the App for free, with ads, affiliate monetization, or other business models now or in the future.
• Your use of the App does not create any ownership interest in the App or entitlement to continued free access.

2.2 Third-Party Purchases

• The App does not sell products directly to you.
• Any purchase you choose to make is completed on a third-party platform, including eBay, under that platform's terms, policies, pricing, shipping, return, and buyer protection rules.
• We do not process your payments, fulfill orders, handle returns, or resolve disputes between you and sellers.

2.3 Future Changes

• We reserve the right to change App features, pricing, monetization methods, or access terms at any time, with notice where required by applicable law.

3. Use of the App

3.1 License Grant

• We grant you a limited, non-exclusive, non-transferable license to use the App for personal, lawful purposes related to discovering deals and browsing eBay listings.

3.2 Prohibited Activities

You agree not to:

• Use the App for unlawful purposes or in violation of eBay's terms, policies, or applicable laws.
• Reverse engineer, decompile, modify, or create derivative works of the App.
• Attempt to gain unauthorized access to any systems, services, or data.
• Use bots, scraping, automation, or abusive traffic patterns that interfere with the App or third-party services.
• Misuse listing information, seller information, or affiliate links made available through the App.

4. eBay and Third-Party Service Disclaimer

• Not Affiliated with eBay: This App is an independent tool and is NOT affiliated with, endorsed by, sponsored by, or approved by eBay Inc. eBay is a registered trademark of eBay Inc.
• No Official Partnership: We have no business relationship, partnership, or official agreement with eBay Inc. unless expressly stated otherwise.
• Independent Service: All product names, trademarks, brands, and registered trademarks mentioned in this App are property of their respective owners.
• eBay Account and Policies: Certain features or linked purchases may require your own eBay account. You are solely responsible for complying with eBay's user terms, policies, and community standards.
• Third-Party Platform Risk: Listings, seller profiles, item descriptions, item condition, shipping estimates, return policies, and prices are controlled by third parties, not by us.
• Data Access: We may access publicly available listing information or third-party feeds. We do not guarantee continuous access to any third-party data source and are not responsible if those providers change, restrict, delay, or remove access.

5. Listings, Deal Discovery, and Affiliate Disclosure

• Informational Discovery Tool: The App is designed to help users discover listings and potential deals. It does not guarantee that any listing is a good deal, accurately described, authentic, available, or suitable for your needs.
• Listing Accuracy Not Guaranteed: We do not verify seller identity, item authenticity, item condition, pricing accuracy, shipping cost, taxes, fees, return eligibility, or listing completeness.
• Listing Changes and Availability: Listings may change, expire, sell out, be relisted, be removed, or become inaccurate at any time. The App may display stale, cached, delayed, incomplete, or incorrect information.
• Incorrect or Mismatched Listings: We are not responsible if the App surfaces the wrong listing, a misleading listing, duplicate listings, counterfeit items, manipulated prices, or listings that do not match your expectations.
• No Purchase Recommendation: Nothing in the App constitutes a recommendation, guarantee, certification, or promise that you should buy a particular item or transact with a particular seller.
• Affiliate Disclosure: The App may include affiliate links, affiliate tags, or other referral tracking. If you click through or complete a purchase, we may receive a commission or attribution credit from eBay or another third party.
• Affiliate Compensation Does Not Change Your Duty to Verify: Affiliate relationships may influence which links are available or how links are tracked, but you remain solely responsible for reviewing the final listing details before making any purchase.

6. User Responsibility and Purchase Decisions

• Your Decision, Your Risk: You are solely responsible for evaluating listings, sellers, prices, shipping, taxes, fees, authenticity, condition, and return rights before purchasing.
• Verify Before You Buy: You should independently confirm the item title, description, photos, seller feedback, compatibility, authenticity, and total cost on the destination platform before completing a transaction.
• No Financial, Legal, or Consumer Advice: The App provides informational tools only and does not provide financial, legal, tax, consumer protection, authentication, or professional advice.
• Disputes Are Between You and the Seller/Platform: Any issue regarding a product, delivery, refund, return, charge, authenticity claim, or seller conduct must be resolved with the applicable seller or platform, not with us.
• Use Your Judgment: You are responsible for exercising appropriate caution when interacting with third-party listings and sellers and for complying with all applicable laws and platform policies.

7. Intellectual Property

All content, features, and functionality in the App (including but not limited to text, graphics, logos, design, and code) are owned by or licensed to Cultivate Digital, LLC and are protected by intellectual property laws.

8. Disclaimer of Warranties

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, or non-infringement.
• We do not warrant that listing data, prices, seller information, deal indicators, or affiliate links are accurate, current, complete, reliable, or available.
• We do not warrant that the App will identify the best deal, the correct listing, or a safe or satisfactory purchase opportunity.
• We do not guarantee that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• We do not warrant the acts, omissions, products, services, listings, conduct, or performance of any third party, including sellers, marketplaces, advertisers, or affiliate providers.

9. Limitation of Liability

• TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE APP.
• This includes but is not limited to losses relating to incorrect listings, failed purchases, item condition issues, counterfeit goods, seller fraud, shipping problems, returns, refunds, charge disputes, missed deals, overpayment, or reliance on App information.
• Our total liability for all claims related to the App shall not exceed the greater of (a) the amount paid by you, if any, for the App during the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (US $100).
• We are not liable for conduct, content, products, listings, policies, outages, or actions of eBay, sellers, advertisers, affiliate networks, or any other third party.
• Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Privacy Policy

• Your use of the App is also governed by our Privacy Policy, which details how we collect, use, and protect your data.
• We do not process your eBay purchases or control the data you provide directly to eBay, sellers, or other third parties.
• We may receive limited affiliate attribution or analytics information related to clicks, referrals, or purchases generated through affiliate links, subject to the applicable third party's systems and policies.

11. Termination

• We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms, misuse the App, or engage in fraudulent, abusive, or unlawful activities.
• We may discontinue the App or specific features at any time without liability.

12. Changes to Terms

• We may update these Terms from time to time. We will notify you of material changes through the App, associated listings, or other appropriate means where required.
• Continued use of the App after changes constitutes acceptance of the revised Terms.
• If you do not agree to updated Terms, you must stop using the App.

13. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles.
• Any disputes shall be resolved exclusively in the state or federal courts located in Michigan.
